Right of withdrawal

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Richard Benes (Studisim), Biberhaufenweg 100/68, 1220 Vienna, Austria, +43 676 6151056, widerruf@studisim.at) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at https://studisim.at/en/withdrawal-form/. If you use this online function, we will send you, on a durable medium (e.g. by email), a confirmation of receipt without delay, including information on the content of the withdrawal declaration and the date and time of its receipt. You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website https://studisim.at/en/withdrawal-form/. If you make use of this option, we will promptly send you a confirmation of receipt of such a withdrawal (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

2. Early lapse of the right of withdrawal

The service we owe is the provision of the data volume specified in the purchased package for its validity period. It is fully provided once the data volume has been used up or the validity period has expired.

In the case of a contract for the provision of services, the right of withdrawal lapses where we have fully provided the service and we did not begin performance until after the purchaser had

1. expressly requested that we begin performance before the withdrawal period has expired, and
2. confirmed that they are aware that they lose their right of withdrawal once the contract has been fully performed by us.

The request and acknowledgement are obtained during the order process by means of a separate checkbox and confirmed on a durable medium (§ 18 para 1 no 1 in conjunction with § 10 FAGG).

For as long as the service has not been fully provided, the right of withdrawal continues to exist. Section 3 applies in that case.

3. Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal in respect of this contract, compared with the full scope of the services provided for in the contract.
